These Terms apply to the public marketing Site only. Access to and use of the Sereniq application at app.sereniqcare.com is governed by a separate subscription agreement (and, where applicable, a Business Associate Agreement) between Aferion and the customer organization. Nothing on the Site constitutes that agreement or grants any right to use the Sereniq platform.
The Site is intended for business users who are at least 18 years old. By using the Site, you represent that you meet this requirement and that any information you provide is accurate.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own informational and evaluation purposes. You agree not to:
Submitting a demo request or contact form does not create any contractual relationship or obligation on either party. We may contact you regarding your request. We have no obligation to provide a demo, proposal, or any services as a result of your submission.
The Site and its contents (including text, graphics, logos, the Sereniq name and mark, page layouts, and software) are owned by or licensed to Aferion and are protected by intellectual property laws. Except for the limited license above, no rights are granted to you. You may not use our trademarks without our prior written permission.
Content on the Site, including any references to HHSC forms, the HCS and HCBS Handbooks, survey preparation, or regulatory requirements, is provided for general informational purposes only and does not constitute legal, regulatory, clinical, or compliance advice. You are responsible for confirming your own regulatory obligations. References to forms and regulatory materials describe Sereniq’s functionality and are not a substitute for official sources.
The Site may contain links to third-party websites and services that we do not control. We are not responsible for the content, policies, or practices of those third parties, and links do not imply endorsement.
The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on the Site is accurate, complete, or current.
To the fullest extent permitted by law, Aferion and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
You agree to indemnify and hold harmless Aferion from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of- laws principles. You agree that the state and federal courts located in Harris County, Texas will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
